Regenerative Ag: Healing the Planet with Hemp

    By Christina Sasser

The world as we know it is experiencing a time of great transformation. Climate change is now considered a major public health emergency by leading scientists around the world. The world needs a multifaceted approach to combat climate change, and one important way to do so is through radical adjustments to farming practices. According to a 2019 report from the U.N. Environment Programme, agriculture is currently the planet’s largest form of land use, occupying 40% of the earth’s surface and responsible for 25% of greenhouse gas emissions. Regenerative agriculture is a holistic system of farming principles that could change these trends. It seeks to rehabilitate and enhance the entire ecosystem, actually “improving the resources it uses, rather than depleting them.”

Regenerative agriculture is unique in its ability to both reduce greenhouse gas emissions and to also capture them through carbon sequestration, which is the longterm removal of carbon from the atmosphere. When plants photosynthesize, they take in carbon dioxide from the air and transform it into carbon that the plant uses to grow. The excess carbon created during this process is then transported through the plant and into the soil, where it can feed fungi and microbes, which in turn provides more nutrients for the plant. Carbon can remain stored in the soil for thousands of years or can be released back into the atmosphere through farming practices like plowing and tilling, in which soil is mechanically dug, stirred or turned. Project Drawdown, a global research organization that identifies, reviews and analyzes the most viable solutions to climate change, ranks regenerative agriculture as one of the top actions we can take to ensure we have a planet worth living on in the future.

Regenerative hemp farming offers hope for a brighter future amidst the challenges and uncertainty that we face today. Since the passage of the 2018 Farm Bill, there has been a massive increase in hemp cultivation in the U.S. While the market is still nascent and unstable, that hasn’t stopped thousands of farmers all across the country from planting their first crops of hemp. Amongst those farmers, you will find a small but growing group of valiant, compassionate, intelligent farmers who are using the opportunity to grow hemp using the principles of regenerative agriculture, as hemp is a particularly well-suited crop for it. Almost all varieties of hemp are naturally resistant to pests and predators. Harmful pesticides that are typically used in mono-crop industrial agriculture needn’t be used, meaning hemp farms have become havens for pollinators like bees and small birds and animals.

Hemp is an important crop in the regenerative agriculture movement for a number of reasons.

Deep Roots: Despite it being an annual crop, its roots reach down into the soil, helping to hold it together, reducing erosion and also loosening the soil allowing more delicate plants to grow afterward in crop rotation.

Biomass: Some biomass will be harvested for CBD products (which is currently the most widely produced end product), and some of that biomass will return to the soil and decompose, feeding nutrients back into the ground.

Fast Growing: Hemp grows relatively quickly, making an excellent ground cover as the plants easily block out room for weeds. While most cover crops are not commercially valuable, hemp has a relatively high market value, making it a “win-win” for both the soil and the farmer. Scientists estimate that for every ton of hemp grown, 1.63 tons of CO2 is removed, making it ideally suited for carbon sequestration, even more than trees or other plants of similar size.

Bioremediation: Using plants to decontaminate soil and water after industrial pollution or after years of toxin build-up from industrial agriculture can restore the earth. Hemp can easily grow in contaminated soils, absorbing heavy metals and toxins into the plants themselves.

Low Water Consumption: Hemp is a relatively hardy plant, needing much less water than most crops. Food and agriculture are the largest consumers of water, requiring many times more than what we need for personal use. Up to 70% of the water taken from the ground and rivers goes into the irrigation of agricultural commodities. In some parts of the United States, agriculture literally threatens to dry up entire ecosystems, making low water consumptive crops essential in ecologically sustainable farming.

Diverse Applications: Did you know that there are over 50,000 known uses or applications for hemp? Ranging from medicine, food, biofuels, fiber, building materials, paper, textiles, clothing, to a viable replacement for plastics. Every single part of the plant has a useful purpose!

Regeneratively-grown hemp offers humanity the possibility of a beautiful and green new future. It may seem like an impossible dream from where we stand right now, but, just a decade ago, it was hard to imagine that hemp would even be legal, let alone that the cultivation of the plant would grow to over 230,000 acres in just the first season since the Farm Bill was passed!

Even if you are not a hemp farmer, you can directly take part in regenerative agriculture practices right at home, in your own backyards, through the reduction of unnecessary digging, mulching or adding composted organic matter to your soil, as well as using cover crops in your garden (or ground covering ornamental plants) to reduce soil erosion and improve soil structure. Not only is it good for the environment, getting your hands dirty is good for your health, too!

Hemp Industry Call to Action: Vote Hemp Urges Community to Sign Petition Calling for Congress to Allow 1% THC Levels in Hemp

    By Steven Hoffman

Washington, DC-based advocacy group Vote Hemp is urging the hemp community to take advantage of a narrow window on Capitol Hill to sign and submit a petition telling Congress to change the legal definition of hemp to allow 1% THC. Arbitrarily set by Canadian cannabis researcher Dr. Ernest Small in the 1970s, the currently allowed 0.3% limit has proved to be problematic for growers, producers and manufacturers alike, and Vote Hemp and its supporters feel that action has to be taken now.

Even Dr. Small agrees, more than four decades later, that “a 0.3% level is very conservative,” he told Cannabis Now in December 2018. He stressed that the allowed 0.3% THC designation for hemp has had negative implications for biodiversity. “0.3% is proving a little problematical for those who wish to produce some cultivars,” he told Cannabis Now. “It’s an especially stringent criterion [for] those who want to produce CBD. Most of the varieties selected for that have in excess of 0.3%, which is kind of inconvenient.”

“We’ve been trying to think strategically; I don’t want to create false hope given that Congress is going on summer recess in a month, and may not get much done in the last few months of the general election year,” said Eric Steenstra, Executive Director of Vote Hemp. “However, farmers and producers are frustrated, and we need to start making some noise about this. We hope to submit as many signatures as we can in the next 30 days, and encourage all members of the hemp community to sign and share the petition with their friends, colleagues and co-workers.”

In changing the definition, “there would be very few cases of anybody getting their crop destroyed. While the industry continues to work on more stable varieties, people would still have to be careful, but if we moved to 1%, the number of samples that would test hot would be very limited,” Steenstra said.

“Vote Hemp had advocated for a higher level early on, but that did not make the cut in the final legislation,” Steenstra continued. “We had to work across the aisle and made a compromise to help make hemp legal back then, but now, it’s proven the standard doesn’t work for farmers. With both the Farm Bureau and the National Farmers Union having policies on the books supporting higher THC levels (1% for the Farm Bureau; 3% for the Farmers Union), that weighs in our favor.”

The petition, issued this week, beseeches Congress that “many farmers have had their crops destroyed due to the outdated definition of hemp. The hemp industry is creating good jobs in farming and manufacturing and we need to ensure the industry can continue to grow and compete with other countries that allow higher THC levels.”

“We are hoping there will be action; there’s a desperate need,” Steenstra said. “We need to get as many people involved and to recognize that this is critical to the future of the hemp industry. We need the community to step up in a big way…and quickly!”

Steenstra also emphasized that the most important thing is to get as many farmers as possible to sign the petition. “We are upset whenever we see a farmer lose their crop because of this. It’s not acceptable. We have to let Congress know that the industry is on the verge of taking off and this limit is hurting farmers and holding us back.”

    Text of the Petition

Hemp is important to the future of farming in the U.S. and will create farming and manufacturing jobs for sustainable and healthy USA grown products. The 2018 Farm Bill authorized hemp production but used an outdated definition of hemp that does not work for farmers or the hemp industry. The current definition limiting hemp to 0.3% THC has proven unworkable forcing many farmers to destroy their crops because they were slightly over the limit. We need Congress to change the definition of hemp to allow up to 1% THC (tetrahydrocannabinol) so that farmers can grow hemp crops without fearing that they will later have to destroy them.

Please add your name to the petition urging Congress to redefine hemp as up to 1% THC and share this with your friends.

    To Congress:

I support changing the definition of hemp to allow up to 1% THC in the plant. Many farmers have had their crops destroyed due to the outdated definition of hemp. The hemp industry is creating good jobs in farming and manufacturing and we need to ensure the industry can continue to grow and compete with other countries that allow higher THC levels. I urge Congress to change the definition of hemp now so that no more farmers will lose their crops.

What’s Next for the Hemp Industry? Experience Hemp SUMMER SOLSTICE Virtual Conference & Expo Highlights Innovation; Call for Unity

    By Heather Collins

2020 has been a pivotal year due to the coronavirus pandemic, which has made a tremendous impact nationwide and globally. These uncertain times have forced businesses, farmers, restaurants, and the hemp community to shift quickly and respond to safety concerns to protect industries.

The producers of the NoCo Hemp Expo and the Experience Hemp SUMMER SOLSTICE Virtual Conference & Trade Show made the hard decision to reschedule NoCo7 to the following year, which will now take place March 25-27, 2021.

“The decision to reschedule NoCo7 was not easy, but we felt the need to protect everyone’s health and safety. This community is so collaborative. That’s what’s going to make this industry stand out as we look towards the future,” said Morris Beegle, Let’s Talk Hemp Media Co-founder and Producer of NoCo Hemp Expo. “We’re excited about in-person events, but until we get the green light, we will continue to plan virtual conferences that further educates and unites our industry.”

Additionally, NoCo Hemp Expo producers are expanding multimedia platforms, including a year in review, fall virtual conference & trade show, a hemp-themed digital magazine, podcasts, weekly newsletter, and more. Stay tuned for additional details on NoCo7 at www.nocohempexpo.com.

SUMMER SOLSTICE Conference Highlights Innovation; Call for Unity

As NoCo7 organizers chart a new course for the second half of this year, the recently held Experience Hemp SUMMER SOLSTICE Virtual Conference & Trade Show, held June 16-19, 2020, was well received.

More than thirty guest speakers, including presenting sponsor PureHemp Technologies, kicked off conversations centered on the evolution of hemp and its potential during these ever-changing times. Participants accessed six live webcast Supersessions, which covered important topics relevant to the industrial hemp market today:

    ·        Innovation: Technology Advances Across the Hemp Supply Chain

    ·        Investor Outlook & the Financial Future of The Hemp Industry

    ·        Food Sovereignty, Nutrition & Hemp’s Role

    ·        Bast & Hurd: Industrial Hemp Opportunities in Building, Biocomposites, Biofuels & More

    ·        The 2020 Hemp Crop: Harvesting, Drying, Handling & Finding Markets

Among the highlights included an earnest discussion on the arbitrary .3% vs. the 1% solution in which hemp advocates declared the current ruling as a roadblock for farmers. “We need to change federal guidelines while working with the USDA. We can do that by telling the stories of the farmers. Their stories will hopefully get us there so we can stop decriminalizing the pioneers of our industry. Without the farmers, we have nothing,” says Doug Fine, bestselling author, hemp farmer, and renowned industry advocate.

Beegle agreed, “There is so much passion in our industry, and this .3% burden should not be on the farmer’s shoulders. Our only option in getting legislation passed is to stand together. We know there is a better solution out there, we need to unite on all fronts.”

Additionally, panelists discussed hemp’s potential in using the entire plant for fiber, textiles, building materials and more, and addressed hemp as a key ingredient for food sovereignty.

Participants also heard from investors regarding hemp’s economic outlook and viability as a commodity beyond the CBD market. “Fiber and hurd are the next big thing. Before, it was all about CBD and smokable flower. Let’s get the right suppliers with the right buyers and bring the best products to market,” said Julie Lerner, CEO, PanXchange, Inc. “We are in a nascent stage, and we still have some growing up to do, but need to be taken seriously.”

Geoff Whaling, a hemp industry leader, offered sound advice for hemp farmers and manufacturers during these uncertain times. “Buckle down. Believe in your business and do not let anyone test your conviction,” said Whaling, Collective Growth Corporation. “In the words of a famous quote, ‘The dreams never die, just the dreamers.”

Dreaming big might be the plan for many hemp farmers this year, but dreaming too big without the right strategy could be troublesome. “I encourage every farmer out there right now to talk about their end-use. Have a plan in place for the hemp you put in the field today,” said Andrew Bish, CMO, Bish Enterprises. “Decisions made later are not good – sort it out now, before it’s too late.”

Traceability and supply chain were also significant points of discussion during the conference. Panelist Joe Witte urged companies to integrate an authentic supply chain and one that is trustworthy. “Embrace traceability because the companies and manufacturers that realize that traceability is everything are the ones who will win.”

Sustainability and Food of the Future

Hemp plays a vital role in sustainability and has the potential to be a superfood. It is high in antioxidants and could appeal to people everywhere for its health benefits. However, there are still some challenges that food brands face in order for them to include hemp as an ingredient in food.

“We are putting a chokehold on this planet with the limitations. We need to be building the relationship with this plant,” said Winona LaDuke, hemp farmer, and nationally known environmental activist. “It’s all about cooperation these days. We need to learn together and form the next economy in equality and in our food system.”

Investors believe that there is still a learning curve when it comes to hemp, yet they remain hopeful. “The birth of an industry doesn’t happen overnight. Entrepreneurs and investors need to recalculate, especially right now,” explained Patrick Rea, CEO, and Founder, Canopy Boulder. “Hemp companies need to take a look and a lesson from the natural products industry and study its success, including dynamics, value propositions, and growth over time.”

Due to the coronavirus pandemic, show organizers have had to shift plans in 2020 and remain optimistic in order for the industry and community to flourish. Originally scheduled for March 2020, and then rescheduled for this coming August, organizers made the hard decision to push NoCo7 to 2021, due to guidelines and event regulations set forth by the City of Denver.

“The decision to reschedule NoCo7 was not easy and it was made over a period of time. The industry and our community’s wellbeing is at the top of mind, and in order to protect the health and safety of everyone, we had to make the decision to move the conference to next year,” said Morris Beegle, Let’s Talk Hemp Media Co-founder and Producer of NoCo Hemp Expo. "We're looking forward to an in-person event, but we will continue to plan virtual events that positively impact our
industry, including a fall event that will coincide with this year’s harvest. We also plan to expand upon our Let’s Talk Hemp digital magazine, and will create new multimedia platforms to inform, educate and unite the hemp community.”

Denver, CO (June 3, 2020) – Think you have the next best idea for hemp since CBD? If so, organizers of the NoCo Hemp Expo are encouraging you to participate in the kick-off session of its
4-day Experience Hemp SUMMER SOLSTICE Virtual Conference and Trade Show, June 16 – 19, 2020. The live, virtual webinar, Innovation: Technology Advances Across the Hemp Supply Chain, will feature notable entrepreneurs, business leaders, agricultural pioneers, and investors. Each panelist will discuss emerging trends that are driving the industrial hemp market, such as machinery for farm and harvesting, drone and data collection, plus extraction and processing equipment.

According to the U.S. Hemp Roundtable, hemp has been a leading cash crop for centuries and was critical to the United States during both world wars. Industry trade journals also estimate there are more than 50,000 different uses of industrial hemp from textiles to sustainable building materials to food and potential energy sources. The Experience Hemp panel of experts will explore new ways to use hemp in diverse ways beyond the traditional means of rope and cloth.

“I am very excited to be a part of the ‘Innovation and Technology’ panel. The dialogue is changing, and we’re starting to discuss new ways to work with hemp – as a stalk material and as a potential food source for animals,” said Andrew Bish, COO, Bish Enterprises. “Realizing we can do more with hemp provides an extra layer for our industry. Identifying and discovering more options for hemp helps educate and inform the public, which is key to the future of this industry and what makes our community thrive.”

Long time hemp advocate and legal activist Joy Beckerman with Hempace International will also be a part of the ‘Innovation and Technology’ panel and believes this is a crucial time for the industry. “What a perfect time for consumers to discover and learn even more about this amazing channel of hope. Hemp has opened many doors on various levels, and we need to continue to educate lawmakers, the community, and the media. Hemp is viable to our economy, and I am pleased to be a part of its evolution,” said Beckerman.

Participants will also have the opportunity to hear insights relating to analytics, innovations in testing, product development, packaging design, and the chance to exchange ideas with the panelists.

Innovation: Technology Advances Across the Hemp Supply Chain

The ‘Innovation and Technology’ discussion will take place on Tuesday, June 16, at 11:00 am MDT and is one of six, 90-minute live webcasts, taking place throughout the week. Each Supersession will be offered twice a day, on Tuesday, Wednesday, and Thursday, June 16-18.

Despite Economic Uncertainty Due to Global Pandemic, Hemp Entrepreneurs and Farmers Hope Green is in the Investment Forecast

By Steven Hoffman and Heather Collins

Money might not grow on trees, but for many hemp entrepreneurs, farmers and investors, they are placing bets on the strength of the hemp plant to carry them through this uncertain economic time. The financial impact of the novel coronavirus has been felt industry-wide and has many farmers, entrepreneurs and producers asking questions about what’s in store for industrial hemp for the remainder of 2020.

The market for cannabidiol or CBD, which has driven the growth of the modern-day hemp industry, had been depressed going into the coronavirus, due in large part to FDA’s conflicting views on the substance, reported MarketWatch. Mainstream retailers have been hesitant to offer ingestible, hemp-based CBD products due to FDA’s position – announced in November 2019 – that CBD cannot be added to conventional food or marketed as a dietary supplement.

However, writes Josh Long in Natural Products Insider, “That’s expected to change if FDA issues regulations authorizing CBD to be sold in food, beverages and supplements.” In fact, in a February 2020 speech, FDA Commissioner Stephen Hahn admitted, “People are using these [CBD products]. We’re not going to be able to say you can’t use these products. It’s a fool’s game to try to even approach that.”

Natural Products Insider also reported that BDS Analytics, a market research firm, estimates the market for cannabinoid-infused food and beverage products will reach $5.9 billion by 2024 across all channels, including cannabis dispensaries. That’s up from $906 million in projected sales in 2019, with $560 million, or about 62%, coming from dispensaries, Jessica Lukas, senior vice president of commercial development with BDS Analytics, told the Insider.

Additionally, in late May, promising peer-reviewed research linking high-CBD cannabis extract to helping prevent COVID-19 had the public markets responding positively to CBD stocks. Publicly held companies including Charlotte’s Web, Sundial and others saw their slumping stock prices surge as much as 50% in late May, according to a May 27 article in Forbes – “a very big rally in context,” said Forbes writer Chris Roberts.

“In an unprecedented economic situation such as this, investors will be discerning between those businesses and brands that offer a critical need vs. those selling a ‘want,’” said Patrick Rea, CEO and Founder of Canopy Boulder, an investment firm specializing in brands, tech and services in the cannabis industry. “Also, investors that got burned may be taking a break from the market. However, we are still in the early innings in the development of the hemp industry. There is still significant upside and there is opportunity for investors as public and private company valuations have come down,” he said.

Rea noted that investors are looking at all of the hemp cannabinoids and not just CBD, and also at all the other uses for hemp in fiber, building construction, bioplastics more. “There’s more primary research being done now than ever on cannabinoids, and we should be expecting new science and applications to be rolling through the industry over the next 18 to 24 months for the minor cannabinoids in hemp,” he said. However, Rea cautions, “Investors are getting back to the basics. Just because something can be made from hemp doesn’t necessarily mean it should be made from hemp. There are so many cool applications, but you’ve got to have the right margins, supply chain and a sustainable path to the future to make a good idea into a good investment and a good business.”

For companies, Rea recommends focusing on the things you can control. “For a branded product, that could be putting energy into ‘Direct to Consumer’ or supporting retailers. For suppliers and processors, they may seek to lower their risk; for example, instead of purchasing all the biomass up front – a significant outlay – companies could alternately partner with their supplier and say, give us the biomass up front, and we’ll share in the profits on the back end.”

Also, Rea advises to adjust expenses to lengthen the amount of time businesses have to reach their goals. “In an economy like this, conserve cash. Very few investors at this time will object to a founder cutting their burn and extending their runway.”

Even though no one can really predict what the market will do, investors can look back and see how the commodity did during other times of crisis. For instance, take into account that hemp has endured and survived the 1918 Flu Epidemic, the Great Depression and Prohibition. And here it is today – a green light beacon inspiring innovation, sustainability, and community.

Controversial Debate Regarding Legal THC Levels In Hemp Plant

Controversial Debate Regarding Legal THC Levels In Hemp Plant Sets Stage for Discussion at Experience Hemp SUMMER SOLSTICE, June 16-19, 2020

Hemp Advocates Lobby to Change Rigid Government Policies. Panelists to Discuss Why The One Percent Ranking is the Solution for the Hemp Industry and Why The USDA’s 0.3 Percent is Arbitrary and Wrong. Join the Conversation and Have Your Voice Heard on Hemp Regulations.

By Heather Collins, Compass Natural Marketing

It’s spring and hemp farmers are busy putting seeds in the ground, hoping that this year’s crop will not only be bountiful but safe from destruction due to the USDA’s 0.3 percent mandate. It’s a risk that resonates throughout the industry, specifically for farmers who must wait to see if their crop gets the green light at harvest.

According to the United States Department of Agriculture (USDA), all domestic hemp plants receive THC level testing and cannot exceed 0.3 percent in THC, which differentiates legal hemp from illegal marijuana. For example, the USDA deems that if a tested hemp plant exceeds the mandated 0.3 percent at harvest, then that farmer must destroy that crop.

That mandate has not been favorable in the eyes of farmers, which has left many empty-handed in a field of green hope. Last year, according to Pew Trust’s Stateline, 4,309 acres of hemp in 16 states were destroyed because those plants tested over the 0.3 percent limit. Additionally, Cannabis Business Times reports that the U.S. trails other countries, such as Thailand and Switzerland, where they have enacted the one percent rule for hemp plants.

As the U.S. hemp market continues to evolve, so does the controversial debate between farmers and government officials regarding THC levels found in hemp plants. The discussion has drawn mixed criticism industry-wide and has gained national media attention for the government’s complex policy.

Notable hemp farmer Doug Fine indicated in a recent blog on Vote Hemp that farmers have their work cut out for them this year. “We’ve got to get the federal definition of hemp changed to one percent, pronto, before the recent USDA Interim Final Regulations kick in in October,” wrote Fine. “When up to 40% of an industry’s players – let alone a soil-building, humanity-saving industry’s players – have to destroy their product before it reaches market due to a relic of an absolutely arbitrary war that we’ve won, that is a policy that needs to change. . . this time, the farmers are in charge.”

The 1.0 Percent Solution – Why 0.3 Percent THC is Arbitrary and Wrong

Organizers of NoCo Hemp Expo’s Experience Hemp SUMMER SOLSTICE Virtual Conference and Trade Show are aware of the community’s need to unify and lobby for effective change. That’s why they dedicated a live webcast on the topic during their upcoming Expo: The 1.0 Percent Solution – Why 0.3 Percent THC is Arbitrary and Wrong, June 18, 2:00 pm MDT.

“The hemp industry is fired up regarding this numbers game farmers are having to play with the government, which sets them up for the undue risk. This is a crucial time for our community to unite and effectively lobby for Congress to change the ruling to one percent,” said Morris Beegle, Let’s Talk Hemp Media Co-founder and Producer of NoCo Hemp Expo. “We’re looking forward to this lively discussion at next month’s Expo and hope that people take advantage of the open forum to be heard on this matter.”

  • Tips for Marketing Hemp CBD Products in the Coronavirus Era without Drawing the FDA’s Attention

Tips for Marketing Hemp CBD Products in the Coronavirus Era without Drawing the FDA’s Attention

Tips for Marketing Hemp CBD Products in the Coronavirus Era without Drawing the FDA’s Attention

    By Asa Waldstein

Understanding the do’s and don’ts of how to message a product can mean the difference between a successful business or a legal nightmare.

Recently, the FDA and FTC have been sending numerous Warning Letters to those making both explicit and implicit claims related to the coronavirus crisis. At the same time, many of us have companies to run and families to support, and still need to continue to advertise products and gain market share. It’s difficult to know how to do this in a way that is sensitive to the global pandemic crisis but will also keep us out of FDA, FTC, and class action trouble.

In order to understand how to effectively message products, it’s important to first know what to avoid. As a general rule, anything ending in “itis,” which means inflammation-of, should be reworded. Also, anything a drug is indicated for is considered a claim and should be avoided (e.g. Xanax for anxiety).

All of the COVID-related warning letters mention buzzwords such as COVID, coronavirus, or Wuhan. A good first step in developing marketing content is to remove all such language from websites, socials, blogs, infographics, and videos. This includes hashtags, as an otherwise compliant social media post can garner FDA and FTC attention simply by using a COVID-related hashtag.

Also, I suggest resisting the urge educate the consumer about what the coronavirus is. The line from education to insinuation that a product may help is very thin, especially in this time of FDA/FTC scrutiny. As an example of the overall compliance picture the FDA/FTC looks at, a well-intentioned company may get a warning letter by implying an ingredient supports immune health, mentioning coronavirus on a blog, or posting a customer product review talking about overcoming the flu.

Refrain from eluding that a product will protect from coronavirus. A “reasonable consumer” may then think other measures such as handwashing and masks are not as important, and this is the crux of many of the warning letters. Anything that insinuates this and links to a product shopping cart is fair FDA/FTC game.

    What CAN You Say?

If COVID-related words are necessary, try replacing with generalities such as “this situation” or “the crisis.” It is important to not mislead the consumer, though, and I suggest sticking with quality of life language concerning mood and happiness, and healthy sleep pattern discussion.

Here are some other lower risk ways to communicate how your product can help:

     – Balanced state of mind
    – Happy mood support
    – A good night’s sleep supports the body’s health
    – Support resilience
    – Slumber support for optimal health
    – Mental equilibrium
    – Be kind to your body with hemp oil, your body systems will thank you!

A properly functioning body with low tension and a good mental outlook has better chance at an optimal immune system. Hemp extract is great for this! Hemp is a healing plant and the more widely the message is communicated the more opportunity there is for consumers to utilize its health-giving benefits. Happy ethical marketing!

  • Protecting Your Hemp Intellectual Property

    Protecting Your Hemp Intellectual Property

    Protecting Your Hemp Intellectual Property

The non-profit organization Agricultural Genomics Foundation (AGF) and The Fat Pig Society (FPS) want to invite you to participate in a third party neutral project that will protect  hemp farmers by accelerating the identification, validation and listing of clonally maintained CBD hemp plants. We intend to help identify hemp plants with the highest production and the lowest risk, while ensuring that your  Intellectual property rights and royalties are protected.

Intellectual property (IP)  protection for hemp varieties is rapidly becoming the new hot spot in the hemp green rush. At the same time, hemp regulators are cracking down on the sales of seeds and clones that put farmers at risk. Regulations that mandate hemp to be a certified variety as defined by the Association of Official Seed Certifying Agencies (“AOSCA”) has already passed in many States.

The Hemp industry needs a third party neutral Certification organization, like Underwriters Laboratory Certification for electrical appliances. An unsafe appliance can kill a consumer, and high THC hemp can kill a farm.

We established a simple two-step process in order to participate:

    1. Sign the attached  “Material transfer agreement” and pay the $175 fee per plant ($165 for >100; $150 for >1000). Please make checks payable to Fat Pig Society with Genomic Selection on the Memo line.
    2. Assure seed delivery by May 15th, 2020 or clone delivery by June 1st, 2020 to the following address: Fat Pig Society  317 North Hollywood Street Fort Collins, CO 80521. All clones must be pest free.

Our team will cultivate your plants in the Certified Organic container test field, and with the Organic Integrated Pest Management developed by the Colorado State University (CSU).  Thus, all of the plants in our program will be USDA certified organic.

You will receive two (2) copies of each plant that will be propagated and clonally maintained in vegetative state that will serve as your future foundation plant stock. You will also receive a copy of the chemotype testing results, and a copy of all of the phenotypic (physical) traits we measured. This data contains all the necessary information to enter the Colorado Certified Hemp trials,  file for a listing with the  Association of Official Seed Certifying Agencies (AOSCA) and to file for Intellectual Property at USDA/PVP or USPTO.

Besides being part of the first-of its kind program in the entire country, other benefits of participating in this project include:

-We can identify  if you were cross pollinated with marijuana, kill them, and return the low risk plants for breeders to restart your seed line (or clones).

    – Our project will help you shorten the path to seed stabilization by growing a seed line and allow you to pick out those closest to the  breeding target for the next breeding cycle.

    – You can decide if you want to proceed to file IP or AOSCA, and we will provide the application materials, and all of the necessary information about filing fees estimates, and legal costs. Please Note that we can not fill out applications for plants that test >0.3% THC.

    – the data collected about your plants will be part of scientific studies conducted by researchers from the University of Colorado (CU) Boulder in collaboration with AGF.

    – If we identify a patentable clone variety, you can proceed to full commercialization, Phase 2, of this program. All participants will receive the estimated costs (including the estimated legal fees) and all forms for this next step. Phase 2 includes: Filing for Intellectual property protection- IP; filing for variety listing with AOSCA; entry in the Colorado Certified Hemp  program; plant genome sequencing with posterior analysis by scientists from CU Boulder; patent defense through gene sequencing to identify unauthorized use; and field trials to identify secondary factors like cannabinoid yield per acre, insect and disease resistance, terpenes, etc.

    Meet the Team:

Terry Moran– Project Director- Created and regulated the Nation’s first Certified Hemp Seed Program at the Colorado Department of Agriculture, and has an extensive background in plant breeding, IP, and listing with AOSCA.

Dr. Daniela Vergara, PhD- President and founder of the Agricultural Genomics Foundation, a 501(C)3 non profit. Daniela is one of the world leaders in Cannabis genomics.

Barbara Campbell–  One of the top plant patent attorneys in the USA, that will guide breeders and growers to the  best path to IP, including options such as ‘Plant Variety Protection’ through the USDA and ‘Utility or Plant patents’ at the US Patent Office

Bill Althouse– Founder at Fat Pig Society and a  Certified organic hemp Farmer.  Bill has been selecting for the highest quality hemp CBD clones for over 13 years, has screened over 10,000 individual plants, and has built the test platform and protocols to screen CBD plants at scale.

Iginia Boccalandro– Co-founder of Fat Pig Society and hemp farmer for 8 years. With her extremely approachable personality and knowledge of farming in both the US and South America, Iginia will be in charge of the public relations and administrative work.

  • State of Virginia Legalizes CBD as an Ingredient in Food & Beverage Products

State of Virginia Legalizes CBD as an Ingredient in Food & Beverage Products

    By Steven Hoffman

Virginia Governor Ralph Northam on April 16 signed into law landmark legislation legalizing the use of cannabinoid extracts, such as CBD, derived from industrial hemp as an ingredient in food and beverage products.

The measure states that “industrial hemp extract…is a food and is subject to applicable laws and regulations,” which will be administered by the Virginia Board of Agriculture and Consumer Services. The bill further states that “’industrial hemp extract’ means an extract (i) of a Cannabis sativa plant that has a concentration of tetrahydrocannabinol that is no greater than that allowed for hemp by federal law and (ii) that is intended for human consumption.”

Senate Bill 918, sponsored by state Senator David Marsden (D-Fairfax), will help guide the industrial hemp industry in Virginia by “regulating facility conditions and requirements for the production of hemp-derived products intended for human consumption,” reported NBC News. The bill… “gives validity to the CBD industry,” Charlotte Wright, a Virginia hemp farmer and owner of CBD company Hemp Queenz, told NBC News.

The bill authorizes the Virginia Board of Agriculture and Consumer Services to adopt regulations establishing contaminant tolerances, labeling requirements, and batch testing requirements. In addition, it provides that moneys collected under the chapter shall be deposited in the Virginia Industrial Hemp Fund, created by the bill. The bill directs the Secretary of Agriculture and Forestry to report by Nov. 1, 2020, a plan for the long-term sustainability of funding for the state’s industrial hemp program.

The new law presumably will apply only to products meant to be produced and consumed within Virginia. The use of hemp-derived cannabidiol extract (CBD) in foods and beverage products and dietary supplements is still technically prohibited in interstate commerce, because the FDA has so far refused to recognize CBD as a safe food ingredient.

“While we commend the State of Virginia for taking the initiative to regulate products, we are concerned that a patchwork of state laws could confuse consumers and fail to provide all of the necessary federal safeguards, including setting a safe level of daily consumption for CBD. Unfortunately, this is another example of the states filling a vacuum created by the federal government’s inaction. We have promised to work with policymakers in Virginia and across the country to make real progress on regulating the growing CBD marketplace,” said Daniel Fabricant, Ph.D., President and CEO of the Natural Products Association.

In a letter to Governor Northam dated April 21, 2020, Fabricant wrote, “Congratulations on being the first state to declare cannabidiol (CBD) as a food under the law of the Commonwealth. With the signing of Senate Bill 918 into law, we wanted to inquire about the Administration and Board’s plans for implementation of the law, especially in light of the position of the U.S. Food and Drug Administration (FDA). Despite the agency’s actions and message, the market for CBD products in the US is surging and consumers are confused, Fabricant continued. “With these factors in mind, is the goal of the Commonwealth to challenge the current position of the FDA with regard to CBD or, is it to work with them on developing a Federal Standard with regards to CBD safety and quality standards?” he asked.

  • A Letter from WAFBA Headquarters

    A Letter from WAFBA Headquarters

Hello from the WAFBA headquarters here in Fort Collins, Colorado, remote, virtual, quasi-quarantined and in front of a screen like all of you.We were fully geared up heading into the 7th annual NoCo Hemp Expo originally scheduled for March 26-28 up until two weeks ago when the cascading effect of the Coronavirus started to hit the United States. It began for us at the Natural Products Expo West in Anaheim, California on March 2nd when the show got postponed right as we were standing in the hotel lobby as the event was about to begin.

Then SXSW canceled on Friday March 6th after holding out against the coming wave of pressure to call it off. Those two events in particular, along with a growing list of other factors, pushed us into a reorganizational and frenzied weekend followed by a late Monday morning announcement that we were rescheduling NoCo Hemp Expo and moving the date to August 6-8, 2020.

Since that announcement it has been nothing but more announcements of event cancellations, school closures, concert tours and festivals postponed, bars and restaurants shutting down, or only offering pick up and delivery, and life as we knew it, is rapidly changing for our entire society. Oh, and the economy is tanking faster than anything we’ve seen in our recent history. It has been a lot for all of us to believe and digest the last several weeks here in the U.S. and throughout the world.

Where will we go from here? That’s a good question and one that has a variety of answers based on a multitude of variables. Without getting long and drawn out on all the possibilities, we plan on fighting through this with like-minded friends, colleagues and partners, knowing that life and society will go on after the dust settles from this global pandemic.

For the hemp industry, which we’ll focus on here, still in its infancy, barely legal, with infrastructure and supply chain issues, over supply and pricing issues, regulatory and legislative issues, and on and on…it is important that we all still communicate, collaborate, and work towards the common goal of building a legitimate and functioning hemp industry. This legitimate and functioning hemp industry needs to be based on the principles of the amazing benefits this plant provides and that all of the advocates and activists have preached for years.  That hemp can feed us, clothe us, house us, fuel us, heal us and help restore some balance to the planet.

More, now than ever, with the state we’re in today, it is proof that we all need local resources if our world shuts down. No other agricultural crop on earth can provide the amount of beneficial ingredients for food and supplements and high quality eco-friendly materials for industrial applications. For society today, there is no better time than now to look at correcting our deficiencies in relationship with the earth and we can start with this plant we call hemp.

Here at WAFBA, we are for better alternatives, and one of those is choosing optimism over pessimism. We hope you will do the same.

    Thanks,
Morris Beegle, Elizzy Knight, Lori Buderus

7th Annual NoCo Hemp Expo Reschedules Denver Event to Aug. 6-8, 2020, Out of Coronavirus Concerns

As the U.S. and the world respond to the global coronavirus outbreak, a number of natural products, hemp and cannabis-related industry events have been cancelled, rescheduled or postponed, including Natural Products Expo West in early March, Austin’s South By Southwest in mid-March, the American Herbal Products Association’s Hemp-CDB Congress in April, the International Cannabis Conference in Berlin, CannaTech in Israel, and others.

In a proactive move, organizers for the 7th Annual NoCo Hemp Expo – the world’s largest gathering of hemp industry professionals – announced they are rescheduling this year’s three-day Investor Forum, Business Conference, Farm Symposium, and robust Exposition Hall out of concern for the coronavirus (COVID-19) outbreak.

Originally scheduled for March 26-28, 2020, the trade show will now take place the weekend of August 6-8, 2020, in the same locations, which include the Renaissance Denver Stapleton Hotel and the National Western Complex in Denver, Colorado.

“The decision to shift the timing of this year’s Expo has not been an easy one. The health and safety of all participants remains a top priority. We want to provide attendees, exhibitors, vendors, staff, industry partners, and others involved in the Expo enough time to rework their schedules and plan accordingly for the newly announced August dates,” said Morris Beegle, Producer, NoCo Hemp Expo. “We’re also exploring options for a potential online digital conference in the coming weeks to continue the conversation about hemp. We look forward to creating a robust, powerhouse event in August and appreciate everyone’s support.”

  • Trump Administration Asks for $5 Million Extra in 2021 Budget for FDA to Regulate CBD Products

Trump Administration Asks for $5 Million Extra in 2021 Budget for FDA to Regulate CBD Products

    By Steven Hoffman

Even though the production and sale of all products derived from hemp was made legal in the United States under the 2018 Farm Bill, the U.S. Food and Drug Administration (FDA) in November questioned the safety of hemp-derived CBD in dietary supplements and food and beverages, causing disruption and uncertainty in the booming market for CBD and hemp extract products. Now, the Trump administration in a 2021 budget plan announced in February it is asking for an additional $5 million in the next fiscal year for FDA to regulate cannabis and its derivatives, including CBD, Hemp Industry Daily reported.

The request for additional funding to regulate hemp-derived CBD products comes shortly after legislation was introduced in January in the U.S. Congress to require FDA regulators to treat hemp-derived CBD as dietary supplements, Hemp Industry Daily reported.

FDA said the extra $5 million requested would help advance regulation of products containing CBD while allowing the agency to enforce the law against companies making unsubstantiated medical claims about the products, according to Hemp Industry Daily. “New funding will enable FDA to better regulate the usage of cannabis-derived substances, such as cannabidiol (CBD), in FDA-regulated products such as dietary supplements and when used as unapproved food additives, FDA said in its budget proposal. “The initiative will support regulatory activities, including developing policy, and continue to perform its existing regulatory responsibilities including review of product applications, inspections, enforcement and targeted research,” the agency said.

Included among the activities that would be supported under FDA’s FY2021 budget request would be inspections of facilities manufacturing cannabis-derived products, additional research and funds for processing product-review applications, Natural Products Insider reported. The additional $5 million would be allocated as follows: $2 million for the Office of Regulatory Affairs; $500,000 for the Center for Veterinary Medicine; $2 million to the Center for Food Safety and Applied Nutrition; and $500,000 for FDA headquarters.

Dietary supplement industry trade associations were cautiously supportive of the budget request. “This is a step in the right direction and is an indication that the agency has the resources to regulate the industry. However, this does not go far enough to specifically address the issue of setting safe level of daily consumption for CBD products. Setting a safe level of consumption for CBD products is the best way to move forward with this promising new product while protecting consumers,” said Daniel Fabricant, Ph.D., President and CEO of the Natural Products Association (NPA).

NPA supports legislation passed by the U.S. House of Representatives that would appropriate $100,000 for the FDA to perform a Health Hazard Evaluation (HHE) and set a safe level of CBD for consumers to use each day. The process would follow the same precedent as red yeast rice, which allows a natural product to contain a level of a drug ingredient that the FDA has determined to be safe, NPA said in a statement. According to the World Health Organization, CBD oil is generally recognized as safe.

  • Striking a Balance: Creating a Regulatory Framework for Hemp

Striking a Balance: Creating a Regulatory Framework for Hemp

By Maureen West, General Counsel/Compliance Officer, Functional Remedies

Creating a regulatory framework is a major undertaking. The 2018 Farm Bill, which authorized the USDA to regulate the cultivation of industrial hemp, has proven to be a big job for USDA regulators. Many state departments of agriculture are also busy creating their own regulatory framework. Individuals, many of whom have never been involved in a regulatory process, have become passionate about promoting the interests of hemp farmers and are working side-by-side with others including lobbyists and special interest groups.

The challenge for all of these “players” is to strike the right balance between too much government regulation that unnecessarily burdens hemp farmers against insufficient regulation that leaves hemp farmers uncertain about how to safely grow hemp.

With all the attention targeted towards hemp regulation, it’s worth noting that government regulation is everywhere and impacts almost every aspect of our daily lives. Hemp farmers and individuals interested in hemp farmer regulation can learn a lot from studying other government regulation models particularly those models that issue licenses. This approach can bolster advocacy for hemp regulation and save time by not re-inventing the regulatory wheel.

One issue that government regulators frequently grapple with pertains to the criminal background of applicants. Many types of applicants are subject to this scrutiny including doctors, nurses, barbers, midwives, acupuncturists, plumbers and electricians. In some regulatory programs, any history of criminal conduct may serve as a ground for denial of an application. In other regulatory programs, the applicant’s criminal conduct won’t serve as a basis for denial unless the conduct relates to the type of license being sought.

Although a government agency may deny an application, the denial may be overturned if there is statutory law that requires the government agency to consider whether the applicant has been properly rehabilitated. When this type of statutory law exists, and if the applicant can provide sufficient evidence that they are now a law-abiding citizen who has paid their restitution to society, a court is likely to find that the applicant is entitled to the license. In the interest of good public policy rehabilitation should be encouraged and recognized because of its benefit to society as a whole.

Arguably, it makes for bad policy when a regulatory rule provides a definitive time period during which a hemp farmer with a drug related offense is strictly prohibited from being issued a hemp grower license. Consideration about whether the applicant is rehabilitated is an equitable approach and affords the applicant an opportunity to move on with their life. If doctors and nurses who demonstrate rehabilitation can be issued a license which permits them to provide direct patient care, shouldn’t this same opportunity be afforded to a hemp farmer applicant who simply wants to grow a crop?

Another issue typical of licensure regulation pertains to the definition of “reasonableness.” In its final interim rules, the USDA makes reference to whether a farmer has made “reasonable efforts to grow hemp.” Essentially this provision poses the question of whether the farmer took reasonable steps to avoid growing hemp that exceeds the 0.3% THC threshold. In the regulatory arena, what constitutes “reasonableness” is most often the subject of hot debate that prompts a battle of the experts, both of whom are qualified to speak about what they believe is “reasonable.”

During this infancy stage of growing hemp in the United States, it’s questionable whether it is even possible to accurately determine what “reasonable” hemp growing entails. There exists a lack of information about how a given crop will perform when exposed to different altitudes, temperatures and other environmental conditions which exist in different parts of the country and even within a state. If other, more seasoned regulatory bodies, face challenges about with the meaning of “reasonableness” it’s fair to conclude that it’s premature for the USDA to hold hemp growers to this standard.

Regulation of any type of license is an ongoing exploratory process where rules are constantly subject to change. There is a lot of work to do and it’s going to take a lot of heavy lifting to move hemp farmer regulation forward. Looking to other regulatory models won’t provide all of the answers, but it might lighten the load.

States Take the Lead: Colorado’s CHAMP Hemp Initiative Welcomes Public Comments in Responding to USDA’s Interim Final Rule on Hemp

    By Steven Hoffman

As state and industry leaders sift through USDA’s Interim Final Rule set to govern U.S. hemp production in order to craft a response in advance of the December 30 comment deadline, a number of common concerns are emerging, not the least of which is the rule’s increased potential to place farmers at risk.

The Colorado Department of Agriculture’s Hemp Advancement & Management Plan (CHAMP) initiative welcomed on December 10 more than 100 hemp industry members, advocates, farmers, researchers, academics and others to the agency’s office in Broomfield, CO, for a public meeting to hear comments on the USDA Interim Final Rule (IFR) to establish a national hemp production program and how it affects the state’s own plan for hemp.

The goal of the hearing was to gather comments from the public and coordinate a unified response from the state of Colorado to the USDA in advance of USDA’s December 30 comment period deadline regarding the Interim Final Rule governing U.S. hemp production. In addition, state leaders gathered information at the hearing to help align Colorado’s comprehensive hemp plan with IFR requirements.

Brian Koontz, Manager of the Colorado Department of Agriculture’s Industrial Hemp Program (right), shares the state’s concerns over USDA’s Interim Final Rule for U.S. hemp production at a public hearing in Broomfield, CO, on December 10.
